1. Scope
These General Terms and Conditions ("Terms") govern all purchases made through the online shop operated by Mixxx e.V. ("Mixxx e.V.", "we", "us", or "our").
The online shop is available to both consumers (§ 13 German Civil Code - BGB) and businesses (§ 14 BGB).
Any terms and conditions of the customer that conflict with or deviate from these Terms shall not apply unless expressly agreed in writing.

3. Products
The online shop offers merchandise, promotional items, digital products, event-related items, and other goods supporting the activities of Mixxx e.V.
Product images are for illustrative purposes only. Minor deviations in colour, appearance, packaging, or design may occur and do not constitute defects where they are reasonable and customary.
4. Formation of Contract
The presentation of products in the online shop does not constitute a legally binding offer.
By submitting an order, the customer makes a binding offer to purchase the selected products.
After an order has been placed, the customer will receive an automatic acknowledgement of receipt by email. This acknowledgement does not constitute acceptance of the order.
The purchase contract is concluded only by sending an order confirmation or by dispatching the ordered goods.
Mixxx e.V. reserves the right to reject orders where justified, including in cases of pricing errors, unavailable products, suspected fraud, or legal restrictions.
5. Prices, Currency and Taxes
Prices are displayed in Euro (EUR). Depending on the destination, supported currencies may be offered during the payment stage, by our Payment Service Provider. These may induce charges which we are not in control of.
All stated prices are final prices. Pursuant to § 19 of the German Value Added Tax Act (UStG), no VAT is charged (small business regulation).
Shipping charges are shown separately before the order is completed.
For deliveries outside the European Union the shipping costs include all applicable customs duties and import taxes. Incoterm: Delivery Duty Paid (DDP).
Mixxx e.V. reserves the right to refuse or cancel orders where delivery would violate applicable export control laws, sanctions, customs regulations or other legal requirements, or where exceptional and unforeseen customs duties or other government-imposed charges make delivery unreasonable. In such cases, the customer will be informed without undue delay and any payments received will be refunded in full.
In the case of custom on-demand product, the customer is responsible for covering any additional shipping fees required for a second delivery attempt if the initial shipment is returned to Mixxx e.V. due to any of the reasons listed above.
6. Payment
Payment may be made using the payment methods displayed during checkout.
Payments are processed through secure third-party payment service providers.
Where payment is made in a currency different from the customer's bank account, exchange rates and conversion fees are determined by the payment provider or financial institution. Mixxx e.V. is not responsible for such charges.
7. Shipping and Delivery
Mixxx e.V. ships to Germany and selected international destinations.
Available shipping destinations are shown during checkout.
Delivery times are estimates and may vary due to customs processing, transport providers, local postal services, public holidays, or circumstances beyond our reasonable control.
Customers are responsible for complying with import regulations applicable in their country.
If delivery fails because the customer refuses delivery, or provides an incorrect delivery address, Mixxx e.V. may deduct any resulting costs from the refund where legally permitted.
Risk transfers in accordance with applicable statutory law.
Mixxx e.V. shall not be liable for delays or failure to perform resulting from events beyond its reasonable control, including natural disasters, strikes, transport disruptions, governmental measures or similar events.
8. Retention of Title
Goods remain the property of Mixxx e.V. until payment has been received in full.
9. Right of Withdrawal
Consumers who are entitled to a statutory right of withdrawal under applicable consumer protection law may exercise that right in accordance with the applicable legal provisions. Details are provided in our separate Withdrawal Policy.
For consumers located within the European Union, the statutory right of withdrawal applies in accordance with applicable consumer protection legislation.
Exception for pre-sale print-on-demand products: In accordance with Article 16(c) of the EU Consumer Rights Directive (Directive 2011/83/EU) and Section 312g (2) No. 1 of the German Civil Code (BGB), the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. Products offered during pre-sale campaigns are manufactured exclusively after the campaign has ended and only in the quantity, size, and style ordered by each customer. As these products are produced individually based on the customer's order, are not held in stock, and are not suitable for ordinary resale, they are considered goods made to the customer's specifications.
In the event of incorrect or defective delivery, customers can contact us within 14 days of receipt of the goods to discuss a resolution (e.g., replacement delivery or refund).
Nothing in these Terms limits any mandatory consumer rights applicable under the laws of the customer's country of residence.
10. Returns
Returns must be made in accordance with the published Withdrawal Policy.
Returned goods should, where reasonably possible, be complete and appropriately packaged.
This provision does not affect mandatory statutory rights.
11. Warranty
Consumers are entitled to the statutory warranty rights provided under applicable law. These rights are not limited by these Terms.
For business customers, warranty rights may be limited to the extent permitted by applicable law.
12. Liability
Mixxx e.V. shall be liable without limitation for:

intentional misconduct;

gross negligence;

injury to life, body or health;

liability under mandatory statutory provisions.
In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damages typical for the contract.
Nothing in these Terms excludes liability where exclusion is prohibited by law.
13. Intellectual Property
All content published within the online shop, including text, graphics, photographs, logos, software, and other materials, remains the intellectual property of Mixxx e.V. or the respective rights holders.
No content may be copied, reproduced, distributed, or used commercially without prior written permission unless permitted by applicable law.
14. User Accounts
Customers may create a user account for future purchases.
Customers are responsible for maintaining the confidentiality of their login credentials.
Mixxx e.V. reserves the right to suspend or terminate accounts used unlawfully, fraudulently, or in violation of these Terms.
15. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers residing outside Germany, mandatory consumer protection provisions of the country of residence remain unaffected where they cannot legally be excluded.
16. Consumer Dispute Resolution
Mixxx e.V. is not obliged and does not voluntarily participate in dispute resolution proceedings before a consumer arbitration board unless required by mandatory law.
Customers are encouraged to contact Mixxx e.V. directly to resolve any issues concerning an order.
If the customer is a businesses, the exclusive place of jurisdiction for all disputes arising from or in connection with these terms shall be Hamburg, Germany, to the extent permitted by applicable law.
Mandatory statutory provisions regarding jurisdiction for consumers remain unaffected.
17. Severability
Should any provision of these Terms be held invalid or unenforceable, the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by the applicable statutory provision to the extent necessary.
